The Supreme Court on Friday struck down a condition in the CBSE board’s assessment policy in June last year, which said that the marks obtained in the next examination would be considered final for the assessment of 12th class students. A bench of Justices Khanwilkara and Rabikumar said that the Central Board of Secondary Education would provide the candidate with an option to take the best of the two marks obtained in this regard so that the final result could be declared, last academic session.

Students who took the CBSE exam last year

The Supreme Court, while hearing an application filed by some students who appeared for the CBSE exams last year to improve their marks in Class 12, had a policy clause dated June 17, 2021 in the 28th complaint. Where it is stated that according to this principle the marks obtained in the next examination will be considered as final.

Removal of the terms mentioned in section 28

The Supreme Court observed that the petitioners alleged that this condition was inserted while leaving the previous schemes, where the result was considered for the final declaration between the two marks obtained by the candidate in any subject.
Consequently, we have no hesitation in removing the condition mentioned in section 28 that, according to the policy, the marks obtained in the next examination will be considered as final, the bench said.

To make more student-friendly provisions

It was observed that CBSE did not give any reason for such departure. CBSE XII board exams were cancelled last year due to the epidemic. The bench, which disposed of the application, observed that the policy needs to be adopted due to the challenging situation faced by the students and it justified the creation of more favourable provisions for the students.

Let us be fair, why this is not possible?

Initially, the CBSE counsel said that the students’ progress has been assessed on the basis of the test and now they will not be able to take advantage of this policy. How does it affect you? Why this is not possible, it should be fair, – said the bench.

The apex court was hearing an application filed by 11 students whose asessment policy was announced by Board’s at Thirty (30) : Thirty (30) : Forty (40) to pass the original results and then to appear in the August-September improvement test.
The lawyer sought directions from the concerned authorities to retain the original results of the petitioners instead of the results of the revision test in the petition filed for publication.

Some students should not worry about CBSE

Hearing the matter last month, the apex court had said that the CBSE should consider improving the number of students who took the exam last year in class 12, but getting lower marks, as it was not safe for them. The Supreme Court of Higher Education has said that students participating in the reform examination were admitted on the basis of their actual results and this should not be a problem.
