Supreme Court approves evaluation plan; says, “There is no reason to interfere because it is just and proper”. The Supreme Court began its hearing at 2 pm and heard petitions related to CBSE compartment exams, CBSE private exams, repeater exams, and adoption of uniform norms for state boards.
The Supreme Court on Tuesday began hearing a petition regarding evaluation criteria adopted by the Central Board of Secondary Education (CBSE) and the Council for the Indian School Certificate Examinations (CISCE). The top court began its hearing at 2 pm and heard petitions related to cancellation of CBSE compartment examination, CBSE private examination, repeater examination and adoption of uniform norms for state boards.
Earlier on Monday, the court said that even though it has agreed to the evaluation plan, it will hear the petitioners before suggesting any changes in it.
Now the time has come for which the whole country was waiting. At around 02:45 pm, the Division Bench of Justice AM Khanwilkar and Justice Dinesh Maheshwari soon began hearing the matter.
Responding to petitioner Anshul Gupta’s question on how the Class 12 examination is a threat to these students and no other examinations, the Supreme Court bench said, “Each board is different. Equipment has to be arranged. The board is conscious about this. The decision has been taken by the highest authorities and it is a well-informed decision. ”
We have made it clear earlier that we are not inclined to change that proposal. If other boards are taking the exam, it doesn’t mean that CBSE has to do the same.
The Supreme Court bench told the petitioner, “Students approached us saying that uncertainty is affecting their psychology. Then the authorities took note of it. Should we reverse it now and put lakhs of students into uncertainty?
There is a test there. If you want to appear, you can. If it should be made available then it is yet to be considered by us.
CBSE compartment exams may be held from August 15, subject to favorable conditions, Attorney General of India told Supreme Court.
If other boards have conducted the exam, it doesn’t mean that the boards before us are bound to do so. These boards are independent boards. They have taken the decision to cancel the examination which according to them is in the larger public interest of the students.
Objection was raised for compartment, private and Patrachar students. The analogy of the proposed scheme cannot be applied to private, compartment or correspondent students.
The current plan says that an examination will be conducted where all such candidates can appear as private candidates and the examinations will be conducted from August 15 to September 15 and the results will be as soon as possible so that these students can make their career if they want.
In view of this, we believe that there is no need to interfere with the scheme proposed by CBSE and ICSE as there are other groups of students supporting it, and this is also the reason why we find this scheme appropriate. It takes into account the concerns of all the students. Justice AM Khanwilkar said that both the writ petitions are being disposed of.
The bench said there was no reason to interfere with the schemes of CBSE and ICSE, as they were “fair and proper and taking into account the concerns of all the students and in the larger public interest”.
The bench of justice did not appreciate the submission made by Anshul Gupta, a teacher of a private school, who was appearing as a party-in-person, who wanted to conduct the examination.
The Supreme Court dismissed the petitions challenging the decision of CBSE and ICSE to cancel the exams and also allowed to go ahead with the evaluation scheme brought by the board to evaluate the exam pattern of the students.
A bench of Justices AM Khanwilkar and Dinesh Maheshwari dismissed a bunch of petitions challenging the cancellation of the examination.
The decision was “well informed” and taken at the “highest level” to protect the welfare of over 20 lakh students.
The Supreme Court bench also upheld the evaluation plans prepared by CBSE and ICSE, noting that they were judgments of experts in the field, which cannot be “second guessed” by the judiciary.
