The amicus curiae in its detailed report have considered the constitutional principles and various aspects related to sports and has given several implementable directions. Physical literacy should be recognized as a fundamental right protected by Article 21 (protection of life and liberty) of the Constitution, – was one of the suggestions.
The top court, in August 2018, issued notices to the central and state governments on a PIL filed by sports researcher K. Pandey, and subsequently to Sankara-narayanan, an amicus curia to assist it and suggest measures to deal with the issue.
Senior advocate and amicus curiae G. Sankara-narayanan has presented this report in a PIL seeking directions to the Centre and all states to make sports a part of fundamental rights as well as promote sports education in the country.
The report said that since the long-term recommendations may take time to implement, the apex court may consider directing all school boards, including CBSE, ICSE and state boards, to ensure that Starting from the academic year 2022- 2023, at least 90 minutes of each school day will be devoted to free play and games.
The report said the Centre may be asked to set up a National Physical Literacy Mission (NLPM), which includes curriculum design, compliance monitoring and review, grievance redressal and self-improvement mechanisms.
The PIL states that sports – should be included in academics from nursery to post-graduate level and for a fundamental right to education. There should be compulsory provision for sports in the school budget which should be used only for sports activities. Also, there should be a post of Sports Secretary in the student unions.
The government has to make efforts to promote sports education, sports values and sports culture as part of education. Children’s talent and sports ability should be tested right from the primary school days so that the child’s talent can be nurtured and developed through training and education.
It also sought a direction to ensure that all non-residential colleges and schools mandatory allow neighborhood children to use their playgrounds and sports facilities during non-working hours, which Be for free from the academic year starting in 2022. The Court may direct the Ministry of Education to form an Empowered Committee or Working Group consisting of seniors from key Ministries and independent expert. The Committee may be headed by a Court-appointed Convener, which will provide regular reports to the court, – the report said.
