Two separate pleas have alleged that the CBSE failed to properly implement the process of dispute redressal mechanism relating to the result of Class 12 examination, which was cancelled due to the corona-19 pandemic. The pleas claimed that CBSE has failed to implement the process of dispute resolution mechanism prescribed in a circular issued in August 2021 in compliance with the June 17 order of the apex court.
Board Has Failed to Calculate the 12th Marks of the Students:
The Supreme Court on Friday sought response from the Central Board of Secondary Education (CBSE) on petitions alleging that the board was trying to calculate the Class 12 marks of students on the basis of their actual performance according to the 30:30:40 formula has failed. Approved by the apex court and failed to address their complaint.
Case For Hearing On October 20:
The top court had on June 17 approved the evaluation schemes of the Council for the Indian School Certificate Examinations (CISCE) and CBSE, which had adopted the 30:30:40 formula for evaluating marks of students on the basis of Class 10 results and 11, and 12 respectively.
A bench of Justices Khanawilkara and Ravikumar asked CBSE to respond to the petition by October 18 and adjourned the matter to October 20.

The petition alleges that Central Board of Secondary Education (CBSE) provided the mechanism for dispute resolution but failed to implement it only on paper and in reality, causing great loss to the petitioner students and would cause irreparable loss if it goes unresolved.
He sought directions that their results be declared on the basis of 30:30:40 (Thirty: Thirty: Forty) formula and keeping in view the actual marks obtained by them. The petitions filed by class 12 Standard, pass-out students said that since Central Board of Secondary Education (CBSE) has not implemented the process of dispute resolution mechanism, they have been given less marks which has caused them a lot of damage.
