The Supreme Court on Monday said that CBSE’s evaluation scheme for evaluation of marks of Class 12 students whose board exams were cancelled earlier this year due to the coronavirus pandemic has “ATTAINED FINALLY” achieved and obtained the “SEAL OF APPROVAL” of the Court.
This will not Reopen CBSE’s Plan Issue:
Observing that it would not reopen the issue of CBSE’s scheme, the top court said it would not be open to petitioners who have complained about the scheme and evaluation of marks to challenge the scheme.
The top court said that the petitioners are questioning the proportion prescribed in the scheme prepared by the Central Board of Secondary Education (CBSE), which has got the approval of the apex court and similar arguments for review were rejected earlier.
As Regards the Formula, which has Attained Finality:
Disposing of the petition, the bench said that the petitioners will proceed with their representation given to the authority in this regard and a decision will be taken on their merits as per the final plan.
We are making this very clear, as far as the formula is concerned, it has been finalised. We will not reopen that issue, – a bench of Justices Khanawilkara and Ravikumara told the council appearing for the petitioners.
It is not Open to the Petitioners to Challenge the Scheme:
In other words, the petitioner shall not be at liberty to challenge the scheme or the ratio prescribed therein for the purpose of evaluation of marks. It has been upheld and the previous orders have received the seal of approval of this court, – the bench said. It said that the representation should be decided expeditiously within three weeks of receipt of the copy of its order.
Evaluation Schemes Approved by CISCE and CBSE:
It had said that the marks obtained by the class 12 students in practical and internal assessment on the actual basis uploaded by the schools on the CBSE portal would also be considered for deciding the final result.
