A petition has been filed in the Delhi High Court seeking an interim order directing all the schools affiliated to the Central Board of Secondary Education (CBSE) to put on their respective websites the criteria for evaluation of class 10 students. Document publish for all the things must be done very carefully and before the result is calculated and uploaded on the CBSE portal.
The petition was filed by Justice through advocates Shikha Sharma Bagga and Khagesh B Jha. The petitioner’s organization urged the court to issue a direction to bring transparency to the norms framed for evaluation of class 10 students, and also that the students can access it and access the same through the board.
“It is respectfully prayed from this court to pass an interim order directing all the schools affiliated to the Board to prepare their respective criteria for evaluation of Class X students before computing and uploading the results. Publish the rationale document on the websites. On the CBSE Portal, to bring in transparency, so that the students can access it and to raise their grievances with the Board in a timely manner with the Board, Grievance Redressal Mechanism for the students by the Board,” – stated in the petition.
The vacation bench of the Delhi High Court will hear the application on Monday. The petition has been moved in an ongoing “Public Interest Litigation (PIL)” in which the court had issued notices to the CBSE, the Center and the Delhi Court.
The PIL has sought a direction to amend the policy for tabulation of marks of class 10th board examination 2021 on the basis of internal assessment conducted by the school.
The petition states that the petitioner, while accepting the responsibility of being extra vigilant in the PIL, was “expecting that the government would consider illegality to the level of absurdity where CBSE would evaluate the school instead of evaluating the students in such a manner”. Where most of the disadvantaged groups of the society are in more adverse conditions and the policy not only discriminates the children socially and economically but the grievance mechanism is such that CBSE has left them at the mercy of the school.
It further states that there is neither any grievance redressal in case of any mistake in admission by the teacher and inadvertent typing error in teacher’s absence causing the student to pay a heavy cost in terms of his academic career without any of his role.
CBSE had asked the schools to form an eight-member committee consisting of the principal and seven teachers to finalize the results. CBSE Class 10 marks will be calculated for a total of 100 marks out of which 20 marks will be based on internal assessment and 80 marks will be based on their performance in various examinations conducted by the school throughout the year. 80 marks will be further divided into three sections which include 10 marks for periodic/unit test, 30 marks for half-yearly/mid-term exam and 40 marks for pre-board exam.
For schools conducting more than one exam in each category, the results committee will decide how many marks will be allotted to each test. The candidates who are not satisfied with the marks will be allowed to appear in the written test once the pandemic situation becomes normal.
‘Grace Marks’ will also be given to the students if they are unable to obtain the minimum passing marks. Even after giving grace marks, if a student is not able to fulfill the eligibility criteria, he/she will be placed in the category “Essential Repeat”.
Schools have been given time till June 30 to submit the marks. The board has also allowed schools to conduct one-on-one telephonic assessment with students who could not appear in any examination throughout the year.
