PIL for cancelling CBSE 12th Board Exams 2021 as well as other 12th board exams. There is a good news for the students, the public interest litigation filed in the Supreme Court for cancellation of Class 12 board examination 2021 is likely to be heard soon.
Public Interest Litigation gives a comprehensive account of the right to life and personality, which is guaranteed under Part III of the Constitution of India. It also serves as an effective tool for change in social welfare. Through public interest litigation, any public or person can seek treatment on behalf of the oppressed class by presenting PIL.
It renews the expectation of the possibility of students cancelling the exams even as several state boards have announced their decision to move forward with them.
As everyone knows, a PIL was filed in the Supreme Court last week seeking cancellation of pending Class 12 board exams including CBSE, CISCE as well as state boards. However, with the leave of the court and the unavailability of the CJI, the PIL has not yet been listed for hearing.
During the severe condition of Corona-19, where the students and their parents were demanding about the cancellation of board exam and where the “hash tag cancel board exam” and “hash tag CBSE cancel board exam” were trend on various social platforms.
Meanwhile, the states have reportedly shared their feedback on the pending board exams 2021. Most of the states including Punjab, Haryana, Tamil Nadu, Karnataka etc. have shared their intention to conduct the exam. The Gujarat State Board has also released the dates.
Most states told the Union Ministry of Education on Tuesday (25.05.2021) that the Central Board of Secondary Education (CBSE) Class 12 examinations should be conducted, choosing a proposed methodology that includes shorter periods for tests, to be conducted in schools where students are enrolled, and should switch only to multiple choice and short answer questions.
The high-level meeting convened by the Union Ministry of Education on Sunday (23.05.2021) to discuss the feasibility of conducting the exam remained inconclusive, even as officials said there was a “broad consensus” that the exam should be held for a limited number of subjects and should be with less time. The period after the COVID-19 situation came under control.
On Tuesday, only Delhi, Punjab and West Bengal immediately protested the examination, saying they should be conducted only after vaccination of all teachers and students – not only due to the current shortage of vaccines but many students of class 12th Also due to a difficult scheme are those under 18 years of age, a segment for which there are currently no approved vaccines in the country.
Nearly all states told the Ministry of Education on Tuesday 25th May that the Central Board of Secondary Education’s Class 12 exams should be in favour of the second option of short-term exams for 19 major subjects. Only Delhi, Punjab and West Bengal opposed conducting the examination until all the teachers and students appearing for the examination were vaccinated.
There are differences of opinion as to when the examination should be conducted. Some flood and extreme rain prone states like Bihar, Assam and Uttarakhand want the exam to be conducted after the monsoon season.
The Ministry of Education gave the states till Tuesday (25.05.2021) to decide on the CBSE Class 12 exams and choose one of the two options.
The first option was a three-hour examination of 19 major subjects in the month of August. The second option was a 90-minute exam in which students had to appear in only one language and three elective subjects from 15 July to 1 August and then from 5 August to 26 August. The exam will be 90 minutes long and will contain MCQs. The results of both options are proposed to be announced by the end of September.
Apart from this, while CBSE has not yet said so it was clarified that the board is likely to conduct CBSE 12th examination in July 2021. For the CBSE Class 12 Board Exam 2021, the Education Minister is expected to make a final announcement by 1 June.
However, on the insistence of several senior lawyers, the leave bench has said that it will issue directions to the registry to list ‘urgent applications’ before the Chief Justice of India. A bench of Justices Vineet Saran and B.R. Gaval said, “We will issue instructions to the registry to list urgent applications before the Chief Justice of India.” With this, the PIL is expected to be heard soon.
